Spanish Wells History
The Spanish Wells Community is one of the oldest gated communities in Southwest Florida. Plans were created for the community to include a private country club, single family homes, followed by condominiums and villas, all following a common set of standards and rules. A Master Community Association was established to be responsible for common area maintenance (including ponds, lakes and drainage), community safety and general management of the entire Spanish Wells property.
The first homes were built in the 1980s. Sales were immediate and a second section of the property was opened for further construction. As time went eight (8) “sub-associations”, were established. The current Country Club was built in 1998.
Because each “sub-association” has unique opportunities with a variety of amenities and financial obligations, the "sub-associations have individual management. Single family homes with no common landscaping or private property had different financial obligations than do homes with common landscaping or with private property. Condominiums and Villas shared more amenities and expenses than other “sub-associations”.
The Master Association and each Sub-Association have authority over local issues.
Nature of the Organization
Spanish Wells Community Association, Inc. (the “Association”) which is in Bonita Springs, Florida was incorporated on October 07, 1994, under Chapter 617 of the Florida Statutes as a not-for profit organization. The Declaration of Protective Covenants (the “Declaration”) was filed in the official records of Lee County, Florida on March 10, 1995. The current/revised document was filed on July 29, 2020. The Association is responsible for the preservation and maintenance of the common property in accordance with the terms of Florida Statutes, Chapter 720, and the provisions of the Declaration. Spanish Wells occupies a site of approximately 600 acres and consists of 1,361 residential lots,3 9-hole golf courses, country club, tennis courts, pickle ball courts, BOCCE courts and a fitness center.
Executive Officers Of Spanish Wells Community Association
Being a member of the Spanish Wells Community Association Board of Directors comes with responsibilities. The associations recorded “Covenants, Declarations and Bylaws” set forth the powers and duties of the Board and the specific limitations upon the Board's powers. The Spanish Wells Community Association Board of Directors have the power to adopt and publish "Rules and Regulations" to protect the interests of the homeowners of Spanish Wells.
The Board has a President, Vice President, Treasurer, Secretary and Directors. The President and Vice President must be Directors. Otherwise, none of the Officers are required to be Directors. Any Officer may be removed with or without cause by the majority vote of the Directors at any meeting. Any person except the President may hold two or more offices. The Board may, from time to time, appoint such other Officers or committees and define their responsibilities and duties as the Board shall find necessary to manage the operation of the Spanish Wells Community Association.
The Board of Directors must ensure that association members remain compliant with the community's recorded governing documents. Board members should be familiar with not only their associations governing documents, but also any local, Florida's 720 laws and federal laws.
